Colorado House Bill 1139 introduces new regulations to govern the use of artificial intelligence (AI) in healthcare, ensuring patient safety, transparency, and human oversight in clinical decision-making.

The bill mandates that medical necessity and coverage decisions must be made by qualified human clinicians, not solely by AI systems. It also requires AI tools to consider individual patient data and circumstances, with all denial decisions subject to clinician review.

Key provisions include defining mental health companion chatbots and prohibiting them from misrepresenting capabilities or providing unauthorized psychotherapy. Healthcare professionals must disclose AI usage in their services, ensuring informed patient consent.

Additionally, the bill prohibits reimbursement for AI-delivered psychotherapy services under certain healthcare laws, effective 01 January 2027.

These measures aim to promote responsible AI adoption while safeguarding patient care and regulatory compliance in the healthcare sector.
